Quick answer

Since 1 July 2026, employers must get super guarantee contributions into employees' funds within 7 business days after payday. If contributions are late, the ATO assesses a super guarantee charge that includes interest and an administrative uplift. Unpaid super also feeds the director penalty regime, so tradies with staff should clear any backlog quickly, by plan or by finance.

Key points

  • Payday Super replaces the quarterly rhythm; contributions follow each pay run.
  • Late super triggers a super guarantee charge assessed by the ATO, so there is no statement for you to lodge.
  • Unpaid super guarantee charge is covered by the director penalty regime.
  • The charge can be reduced in some cases through a voluntary disclosure, so tell the ATO early.

For years, super could wait until the end of the quarter. In a lean month, many small employers quietly treated it as a short-term buffer. From 1 July 2026 that room has been taken away, and tradies with staff are feeling it first because wages are the biggest cost in most crews.

What does Payday Super change for a tradie with employees?

The core change is timing. The ATO says Payday Super applies from 1 July 2026 and that contributions must reach employees’ super funds within 7 business days after you pay them. The contribution also has to carry enough information for the fund to allocate it to the right member account.

What employers are now expected to do:

  • Pay super with each pay run rather than saving it up quarterly.
  • Calculate it on qualifying earnings, which brings in ordinary time earnings plus other payments such as commissions.
  • Report qualifying earnings and the super liability through Single Touch Payroll.
  • Stop relying on the old small business clearing house, which is no longer available.
  • Use the updated SuperStream standards for payments.

The ATO notes that some exceptions apply to the 7 business day deadline, with new employees given as an example. Check the ATO’s page for the detail on your own situation.

For a crew that pays weekly, it means super leaves the account every week. The cash flow effect is noticeable, so it deserves a line in your weekly planning. Our cash flow gap planner can help you see the pressure.

What happens if the super is late?

When contributions are not received by the fund in time, the ATO assesses a super guarantee charge. You do not lodge a statement for it, because the ATO assesses it. The charge is based on qualifying earnings and includes:

  • The shortfall itself.
  • Interest that compounds daily at the general interest charge rate.
  • An administrative uplift amount.
  • Penalties in some cases.

The uplift can be reduced where the ATO has not previously taken action and you lodge a voluntary disclosure statement. That is a good reason to speak to your registered tax agent as soon as you know a payment is late, rather than waiting for the ATO to find it.

The ATO says the charge itself is now tax deductible, but general interest charge is not deductible when incurred on or after 1 July 2025.

Why does unpaid super matter beyond the charge?

Because it is one of the three amounts covered by the director penalty regime, along with PAYG withholding and GST. A company director can become personally liable if the company does not pay.

The timing rules are the same as for the others. If the super guarantee charge was reported by its due date, a director penalty can be cleared within 21 days of a notice by paying in full, appointing an administrator or a small business restructuring practitioner, or having the company begin to be wound up. If it was reported late or never reported, only paying the company liability in full clears it. An estimate counts as never reported.

Read the detail on director penalty notices. The wages side of the same problem is covered in PAYG withholding debt.

How do I clear a super debt?

You have two main routes, and the right one turns on size, age and any notice.

Route Best when Watch out for
ATO payment plan No notice, steady income, modest debt Super guarantee charge debts are usually arranged by phone with the ATO, interest generally keeps building, and new obligations must be paid on time
Finance paying it in full A notice is near, the debt is older, or you want it gone The business must be able to carry the repayments

An illustrative example, with no real business involved: a landscaping company with six staff falls behind on super across a couple of pay cycles in the first weeks after Payday Super begins. It has not been contacted by the ATO. Reporting the shortfall early and paying quickly, possibly funded by a short-term loan, keeps the charge smaller than waiting would.

Finance for this purpose runs from $20k to $5m when secured by property, and typically $5k to $500k when unsecured. See ATO debt loans for tradies for how that works, or talk to us about clearing the super.

How do I keep super from becoming a problem again?

Treat super like a wage, not a quarterly bill.

  1. Move the super amount into a separate account on every pay run.
  2. Pay it on payday or within a day or two, not at the end of the window.
  3. Check each month that every employee’s fund details are current, because wrong details can delay allocation.
  4. If a pay run looks like it will strain the account, plan the gap before it happens.

If you are unsure about a particular rule or deadline, a registered tax professional can confirm how it applies to your own business.

Frequently asked questions

What is Payday Super?

Payday Super is the change that applies from 1 July 2026. Instead of paying super quarterly, employers must make sure contributions reach employees' super funds within 7 business days after they pay them. The ATO notes some exceptions to the deadline, with new employees given as an example, and super is calculated on qualifying earnings.

What happens if I pay super late now?

The ATO assesses a super guarantee charge. It covers the shortfall, includes interest that compounds daily at the general interest charge rate, and carries an administrative uplift. The uplift can be reduced if you have not had ATO action before and you lodge a voluntary disclosure statement. Penalties can also apply.

Is the super guarantee charge tax deductible?

The ATO says the charge is tax deductible under the new rules, unlike the old charge. General interest charge, however, is not deductible when incurred on or after 1 July 2025. Ask your registered tax agent how this applies to your own return.

Can unpaid super lead to a director penalty notice?

Yes. Super guarantee charge is one of the three amounts covered by the director penalty regime, alongside PAYG withholding and GST. If it was reported late or never reported, the penalty can only be cleared by paying the company liability in full.

Can I borrow to pay a super debt?

You can. A property-secured loan from $20k to $5m or an unsecured option typically from $5k to $500k can be used to clear it, provided the business can carry the repayments. It is a common choice when a notice is close or when you want to stop interest building.
