Quick answer

Most tradies fall behind with the ATO because GST, PAYG withholding or super was spent on running the business, not because they are careless. The main ways out are an ATO payment plan, asking for interest to be remitted, and business finance that clears the debt in one hit. Which suits you depends on the type of debt, any notices received, and how fast the business is earning.

Key points

  • ATO debt in a trade business usually starts as a cash flow squeeze, not a profit problem.
  • Payment plans and finance are not rivals; many tradies use one to buy time and the other to finish the job.
  • Director penalty notices and super have tighter clocks than ordinary income tax debt, so deal with them first.
  • General interest charge keeps building while a debt sits, which is why a clean, early decision matters.
  • Our form takes about a minute and does not involve a credit check at the first enquiry.

Opening a letter from the ATO is rarely anyone’s favourite part of the week. For a sole trader or a small crew, it tends to land when the work is lumpy, the supplier statements are due and the last invoice is still sitting with a slow-paying client. This hub is the starting point for working out where you stand and what you can do about it.

The short version is that tax debt in the trades is common, it is fixable, and the order you do things in matters more than most people think.

How does a tradie end up owing the ATO?

It almost never starts with a decision to avoid tax. It starts with money that was never really yours to spend.

When you are registered for GST, a slice of every invoice belongs to the ATO. The same goes for tax withheld from your employees’ pay, and for the super you owe on their wages. In a lean month, that cash sits in the business account looking like working capital, and it gets used for fuel, materials and wages. A few quarters later the BAS arrives and the money is not there.

Common triggers in the trades include:

  • A big job paid late, so GST was due before the client’s money arrived.
  • A wet-weather stretch with wages going out and little coming in.
  • Growing fast, taking on staff and underestimating the PAYG and super that come with them.
  • A quiet patch after a major project finished.
  • A year of profit that produced an income tax bill nobody put aside for.

None of those is a character flaw. They are cash flow timing problems, and they respond to cash flow solutions.

What are my options for clearing ATO debt?

There are four broad routes, and they can be combined.

Option What it does Worth knowing
ATO payment plan Spreads the debt over instalments Interest generally keeps building, and you must keep new obligations up to date
Interest remission request Asks the ATO to cancel some interest Only where there are extenuating circumstances, and it does not reduce the tax itself
Business finance Clears the debt in one payment, then you repay the lender Suits tighter deadlines, notices or a wish to stop the debt growing
Restructure or insolvency routes Formal processes run by registered practitioners Serious steps with lasting consequences, so get proper professional advice first

We lend, so we are the right people to talk to about the third row. For the others, the ATO itself and a registered tax professional are the right places to start. Our page on ATO payment plans compared with loans walks through how to choose between the first and third.

Which debts are the most urgent?

Not all ATO debts carry the same clock. The ATO’s director penalty regime covers unpaid PAYG withholding, GST and super guarantee charge. In some situations a director can become personally liable for those company amounts, and a notice gives a 21-day window to act. We explain how that works on our director penalty notices page.

Super has also changed. Payday Super started on 1 July 2026, and employers now need contributions to reach employees’ funds within 7 business days of paying them, rather than saving it up for a quarterly run. If you employ anyone, the super page is worth reading before your next pay run: super guarantee debt.

Then there are the debts that are serious but slower:

If you have received any kind of formal notice, treat that as your priority and deal with it before the quieter debts.

What does leaving it cost me?

Interest called general interest charge builds on unpaid amounts, accrues daily and compounds. The ATO reviews the rate every quarter. For general interest charge incurred on or after 1 July 2025, it cannot be claimed as a tax deduction, which means a debt you leave sitting is both growing and not offset against your tax. We do not print rates on this site, because they change and because your own figures matter more, so check the current number on ato.gov.au.

The other cost is options. The longer a debt sits, the more likely it is that notices, firmer action or a director penalty notice enter the picture, and the narrower your choices become.

An illustrative example, with no real business involved: a one-person electrical contractor owes a mix of BAS amounts from two quarters, is on top of current lodgements and has a steady run of work. A payment plan from ongoing income might be perfectly sensible. Change the picture so a director penalty notice has arrived and the company is two weeks from the deadline, and the maths shifts towards clearing the debt in a single payment. Same business, different clock.

Can finance really pay an ATO debt?

Yes. Finance can be used to pay the ATO, and many tradies find that clearing the debt in a single payment gives them room to focus on work again.

  • Property-secured loans from $20k to $5m, as first or second mortgages or caveat loans, residential or commercial security.
  • Unsecured cash flow options typically from $5k to $500k, sized on turnover and bank statements.
  • ATO debt and bad credit are considered case by case, and the loan must be for business purposes.

Funding is not always the right answer, and a good adviser will tell you if a plan or a different step suits better. For a fuller picture of how this works, start with ATO debt loans for tradies, then try the GST and BAS set-aside planner to see how much to put aside going forward.

If you would like to talk it through now, you can start a no-obligation enquiry in about a minute.

Where should I start if I am not sure?

Write down the numbers first. Total owing, split by income tax, activity statement accounts and super. Which quarters. Whether a notice has been received. How much you can realistically find each week. With those four things, any conversation becomes much shorter and more useful.

Then talk to someone. A registered tax agent or the ATO can tell you what is possible on the tax side, and we can tell you what is possible on the finance side. If you speak to a registered tax professional about your own tax position, you will have the full picture before deciding.

Ready to see what you could qualify for?

If the ATO is hanging over the business, you do not have to carry it quietly. Filling in the form takes about a minute, and there is no credit check when you first enquire, so looking at your options costs your file nothing.

Your details come to us rather than being sent to a crowd of lenders, so the phone will not light up with strangers. A real person reads your situation, then calls to talk it through. The more accurately you answer, including the type of debt, the amount and your turnover, the better we can match you the first time.

Frequently asked questions

What happens if I cannot pay my ATO debt on time?

Interest called general interest charge starts building on the unpaid amount, and the ATO will usually try to contact you before escalating. If the debt is ignored, firmer steps can follow, including garnishee notices, credit reporting of eligible business tax debts and director penalty notices. Contacting the ATO or a registered tax professional early gives you the most choice.

Can the ATO forgive or write off my business tax debt?

Not in the way people hope. Release on serious hardship grounds is limited to individuals and deceased estates, and the ATO says GST, PAYG withholding, super guarantee charge and director penalties cannot be released. The ATO may remit interest where there are extenuating circumstances, but the underlying tax still has to be paid.

Is an ATO payment plan better than a loan?

Sometimes. A plan can be easy to set up and suits a debt you can clear steadily from ongoing income, though interest generally keeps building on the balance. Finance suits situations where you want the debt gone in one payment, are facing a director penalty notice, or want to protect your trading position.

Will applying through Tradie Cash affect my credit file?

No credit check is made when you first enquire. We look at your situation, talk to you, and only then work out what could suit. Please fill in the form accurately so we can match you properly first time.

Do I need to own property to get finance for ATO debt?

No. Property-secured loans are available from $20k to $5m, and unsecured cash flow options typically run from $5k to $500k based on turnover and bank statements. Owning property widens the choices and the amounts.
